This website is operated by ilovefelt. Throughout this website and these Terms of Service, “ilovefelt,” “we,” “us,” and “our” refer to ilovefelt. We offer this website, including all information, content, features, tools, products, and services available through it (collectively, the “Services”), to you conditioned upon your acceptance of these Terms of Service (the “Terms”).
By visiting our website, creating an account, submitting information, or purchasing from us, you agree to be bound by these Terms and by the policies incorporated into them, including our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, do not use the Services.
Any new features, products, or tools added to the Services will also be subject to these Terms. Mandatory rights available to you under applicable consumer-protection law are not excluded or limited by these Terms.
You must be at least the age of majority in your place of residence, or use the Services with the permission and supervision of a parent or legal guardian. You may not use the Services for any unlawful or unauthorized purpose.
If you create an account, you are responsible for providing accurate information, safeguarding your login credentials, and all activity under your account. Notify us promptly if you believe your account has been used without authorization.
Many ilovefelt products are handmade, needle-felted, embroidered, or individually finished. Small differences in shape, facial expression, color placement, fiber texture, dimensions, and accessory positioning are natural characteristics of handmade work and do not, by themselves, constitute defects.
We make reasonable efforts to display product colors and details accurately, but screens, lighting, photography, and natural material variation can affect appearance. Measurements are approximate unless a listing expressly states otherwise. Props, stands, lights, display furniture, or background items shown in photographs are not included unless the product description says they are included.
Our felt figurines and decorative pieces are collectible art and home décor, not toys, unless a product listing expressly identifies an item as a toy. Small parts, fibers, wires, magnets, bells, or accessories may present choking or other hazards. Keep decorative items away from babies, young children, and pets, and follow any product-specific care or safety instructions.
Product descriptions, availability, materials, dimensions, and designs may be updated from time to time. We reserve the right to discontinue a product or limit quantities, subject to applicable law.
For custom or personalized work, you are responsible for providing complete, accurate instructions and any requested reference photographs by the stated deadline. Production estimates begin only after we have received the required information and, where applicable, payment.
By submitting photographs, names, dates, text, logos, or other materials, you confirm that you own them or have permission to provide and use them for the requested order. You grant ilovefelt a limited license to use those materials solely to communicate with you, design, produce, fulfill, and support your order. We will not claim ownership of your reference materials.
Custom handmade work is an artistic interpretation and cannot be an exact photographic replica. Reasonable differences arising from the artist’s style, wool fibers, scale, and handcrafting process are expected. Requested revisions, proofs, cancellation rights, and return eligibility are governed by the individual listing, written order agreement, and our Refund Policy.
We may decline instructions that are unlawful, unsafe, hateful, misleading, technically impractical, or that may infringe another person’s intellectual-property, privacy, publicity, or other rights.
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We may accept, reject, limit, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, pricing or listing errors, inability to complete a customization, shipping restrictions, or violation of these Terms.
If we cancel an order after payment has been collected, we will issue the applicable refund to the original payment method. Please review names, addresses, personalization details, sizes, quantities, and selected variants carefully before submitting an order. Changes are not guaranteed after work or fulfillment has begun.
Products are sold for personal use, gifting, display, or collection unless we agree otherwise in writing. Purchase of a physical item does not transfer copyright, reproduction rights, commercial-use rights, or rights to manufacture copies of the design.
Prices, discounts, and promotions may change without notice. The price charged is the price shown at checkout when your order is placed, subject to correction of obvious errors. Unless stated otherwise, product prices do not include shipping, taxes, duties, brokerage fees, or import charges.
You agree to provide current, complete, and accurate billing, payment, contact, and purchase information. You represent that you are authorized to use the payment method submitted. Payment processing may be performed by Shopify or other payment providers under their own terms and privacy notices.
Promotions may have separate conditions. If promotion terms conflict with these Terms regarding that promotion, the promotion terms control.
Processing and delivery dates are estimates, not guarantees, unless we expressly agree in writing to a guaranteed date. Handmade and custom orders may require additional production time. Carrier delays, customs review, severe weather, holidays, incorrect addresses, and events outside our reasonable control may affect delivery.
You are responsible for providing a complete and accurate delivery address and any information lawfully required for shipment or customs clearance. Contact us immediately if an address is incorrect. We cannot guarantee changes after fulfillment has begun.
Tracking scans and delivery records are supplied by the carrier. If a shipment appears lost, damaged, delayed, or misdelivered, contact us promptly so we can review the available information and, where appropriate, assist with a carrier inquiry. Additional details are in our Shipping Policy.
Returns, cancellations, exchanges, damaged-item claims, and refunds are governed by our Refund Policy and any product-specific terms disclosed before purchase. Personalized, custom-made, made-to-order, and final-sale items may be subject to different cancellation or return rules where permitted by law.
Nothing in these Terms limits any non-waivable remedies or cancellation rights that apply under the law where you live.
International customers are responsible for ensuring that products may lawfully be imported into the destination country and for paying applicable duties, taxes, brokerage, handling, or customs charges unless checkout expressly states otherwise. Customs authorities may open or inspect shipments. We do not control customs processing times or charges.
The Services and their content—including original felt characters, sculptures, dioramas, patterns, compositions, artwork, photographs, videos, text, graphics, logos, product names, stories, and page designs—are owned by or licensed to ilovefelt and are protected by copyright, trademark, and other applicable intellectual-property laws.
You may view the Services and share ordinary links for personal, non-commercial purposes. Without our prior written permission, you may not copy, reproduce, trace, imitate, manufacture from, create commercial derivatives of, sell, license, publish, scrape, train a commercial model on, remove ownership notices from, or commercially exploit our designs, images, videos, text, or other content.
Purchasing a product grants ownership of that physical item only. It does not grant permission to reproduce the design, use product images as your own, create molds or patterns, sell copies or substantially similar imitations, or use ilovefelt branding. All rights not expressly granted are reserved.
“ilovefelt” and associated logos, collection names, character names, and branding may be trademarks or source identifiers of ilovefelt. You may not use them in a manner that suggests sponsorship, affiliation, or endorsement without written permission.
If you submit a review, comment, photograph of a completed product, suggestion, or other content intended for publication (“User Content”), you retain ownership of your content but grant ilovefelt a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt for formatting, and use it to operate and promote the Services, subject to our Privacy Policy and applicable law.
You represent that your User Content is accurate, lawful, and does not infringe the rights of others. You must disclose any material incentive received for a review. We may moderate or remove User Content that violates these Terms or applicable law.
This section does not convert private custom-order reference photographs into promotional content. We will not use such private references for marketing solely because they were submitted for fulfillment.
You may not use the Services to: violate law; infringe intellectual-property, privacy, publicity, or other rights; submit malicious code; interfere with security or operation; scrape or harvest data without authorization; send spam; impersonate another person; submit false or fraudulent information; harass or harm others; reverse engineer restricted portions of the Services; or use automated systems in a way that places an unreasonable burden on the Services.
We may suspend or terminate access when we reasonably believe these Terms have been violated.
The Services may include tools, integrations, payment services, social-media features, or links operated by third parties. We do not control and are not responsible for third-party sites, products, policies, availability, security, or content. Your use of third-party services is governed by their terms. Review those terms before using them or providing information.
Our store is powered by Shopify, which provides the commerce platform that enables the Services. Sales made through this store are transactions directly between you and ilovefelt. Shopify is not the seller of our products and is not responsible for their design, manufacture, fulfillment, quality, or use. Your use of Shopify-provided functionality may also be subject to Shopify’s applicable terms and privacy notices.
Our collection, use, and disclosure of personal information are described in our Privacy Policy. Because Shopify hosts the store, Shopify and its service providers may process information needed to operate, secure, and improve the Services.
Occasionally, information may contain typographical errors, inaccuracies, or omissions concerning descriptions, dimensions, availability, pricing, promotions, shipping charges, or transit times. We may correct errors, update information, or cancel an affected order, subject to applicable law. If an accepted order is cancelled because of our error, we will provide the applicable refund.
We do not promise that every product, feature, or part of the Services will always be available.
To the fullest extent permitted by law, and except for express promises stated in a product listing or policy, the Services are provided on an “as is” and “as available” basis. We do not warrant that the website will be uninterrupted, error-free, secure, or free of harmful components.
Products are provided subject to the descriptions and express commitments made at the time of sale. Any disclaimer in these Terms does not exclude warranties, guarantees, or remedies that cannot lawfully be excluded.
To the fullest extent permitted by law, ilovefelt and its service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from use of the Services or products.
Where liability may lawfully be limited, ilovefelt’s aggregate liability for a claim relating to a purchase will not exceed the amount you paid for the product giving rise to the claim. These limitations do not apply to liability that cannot be limited or excluded by law, including liability for fraud, willful misconduct, or other protected claims where applicable.
To the extent permitted by law, you agree to indemnify and hold harmless ilovefelt and its personnel and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or materials you submit that infringe another person’s rights. This section does not require a consumer to indemnify us for our own negligence or unlawful conduct.
You may stop using the Services at any time. We may suspend or terminate access if you materially violate these Terms, misuse the Services, or create a security or legal risk. Termination does not affect rights and obligations that accrued before termination. Provisions that by their nature should survive—including intellectual property, payment obligations, disclaimers, limitations, and dispute provisions—will survive.
We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, fire, epidemic, labor disruption, war, civil disturbance, government action, customs delay, carrier interruption, power or internet outage, or failure of third-party platforms. We will make reasonable efforts to communicate material delays and resume performance when practicable.
These Terms and your use of the Services are governed by the laws applicable in the jurisdiction where ilovefelt has its principal place of business, without regard to conflict-of-law rules, except that mandatory consumer-protection laws in your place of residence remain applicable where required.
Before filing a formal claim, you and ilovefelt agree to make a good-faith effort to resolve the dispute by contacting the other party with a description of the issue and requested resolution. Nothing in this section prevents either party from seeking relief in small-claims court where eligible, pursuing an intellectual-property or urgent injunctive claim, or exercising rights that cannot be waived.
If a provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver.
These Terms, together with the policies and product-specific terms incorporated by reference, form the entire agreement between you and ilovefelt concerning the Services and supersede prior communications on the same subject. If a product listing or written custom-order agreement contains more specific terms, those specific terms control for that order to the extent of any conflict.
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, transfer of the store, or similar business transaction, provided that your rights are not materially reduced contrary to applicable law.
We may update these Terms to reflect changes to the Services, our business, or legal requirements. The revised Terms will be posted on this page with an updated date. Material changes will be communicated where required by law. Changes apply prospectively from their effective date; continued use after that date constitutes acceptance to the extent permitted by law.
